Terms and Conditions

Liabilities | Bookings | Rates & payment | Cancellation

Liabilities

  1. The Publisher reserves the right to reject or cancel any advertisement that in the opinion of the Publisher does not conform to the standards of the publication.
  2. The Advertiser warrants that no work:
    1. shall infringe or prejudice the rights of any third party;
    2. shall be defamatory of any third party;
    3. shall constitute unfair competition or any like tort or civil wrong;
    4. shall infringe the British Code of Advertising Practice.
  3. And the Advertiser further undertakes to indemnify and to keep indemnified the IoL against any costs, claims and expenses which result directly or indirectly from any breach of any of the above warranties.
  4. The Advertiser and its advertising agency each warrants that the advertisement and that goods advertised conform the Trade Descriptions Act 1968 and 1972.
  5. Neither party’s failure to perform any term or condition as a result of Force Majeure conditions such as, but not limited to, war, strikes, fires, floods, acts of God, governmental restrictions, power failures, or damage or destruction of any network facilities or servers, shall not be deemed a breach of contract.

 Bookings

  1. Every booking has to be confirmed in writing by signing a standard advertising contract form. Hereafter cancellation surcharges are applicable.
  2. Verbal copy instructions will be accepted over the telephone and, for the avoidance of doubt, constitute a binding order when accepted. Nevertheless, the Advertiser is requested to provide written confirmation of a verbal booking as far in advance of the publication date as possible and certainly within 5 days of the booking. Faxed confirmations will be accepted.
  3. Copy for inclusion in The Linguist will be provided by the Advertiser by the copy deadline
  4. The Advertiser is to be informed about the copy dead line in advance.
  5. Where no publication date has been specified by the Advertiser for advertising on the website copy will appear on the IoL website within 2 working days of the IoL having received copy.
  6. The Advertiser is responsible for ensuring that copy is accurate. No liability for inaccurate copy will be accepted by the IoL.
  7. Advertisement copy must be supplied by the Advertiser or its agent in accordance with the mechanical data published on the rate card.
  8. In the event of an Advertiser failing to provide copy by the copy deadline, the Institute of Linguists will be entitled to recover 100% of the space cost agreed.
  9. Special positions in The Linguist magazine:
    1. Requests for specific positions will be met as far as possible.
    2. Positioning of advertisements is solely at the discretion of the editor.
  10. Special positions for advertising on the website:
    1. The Advertiser can choose the page on which the web ad shall appear. Any pages and positions are subject to availability.
    2. The following pages will not carry any advertising: the ‘Home’ page and all pages in the ‘About Us’ section.
    3. Recruitment ads will be placed at the top of the ‘Jobs Opportunity’ page in booking order.
    4. Special positions are at the discretion of the Institute of Linguists ’ contact person. 

Rates and payment

  1. Prices are agreed:
    1. for The Linguist: on the basis of camera-ready copy;
    2. for the IoL website: on readily-designed copy. Other production charges will be levied at cost;
    3. a surcharge of £15 will apply if graphics for web advertisments (banners, buttons, tiles and links) have to be resized.
  2. Advertisement rates are subject to revision at any time.
  3. New rates DO NOT apply to bookings accepted prior to the change and remain the same for the existing contracts.
  4. Advertisement rates are exclusive of value added tax, which will be added at the prevailing rate(s) when the advertisement is invoiced.
  5. Single advertisements will be invoiced after publication.
  6. Payment for series booking should be made as follows: 50% should be paid after publication of the first advertisement. The outstanding amount will be equally divided by the number of remaining advertisements and will be invoiced after each advertisement is published.
  7. Series rates apply only if the order is completed within 12 months of the date of the first insertion.
  8. Sponsored links are booked for a minimum of 3 months.
  9. The Advertiser must pay within 28 days from the date of the invoice. The Publisher reserves the right (without prejudice to the Publisher’s other rights and remedies) to charge interest on the past due uncontested amounts at an annual rate of 5% above the base rate of The Bank of England for the time being in force.

Cancellation

  1. The Publisher cannot accept stop-orders, cancellation or transfers unless they are received in writing prior to the Publisher’s stated final copy dates.
  2. Cancellation charges for The Linguist:
    1. 21 days prior to the copy deadline - no penalty charge shall be applied;
    2. between 20 to 14 days prior to copy deadline - 25% of the space cost agreed is payable;
    3. between 13 to 7 days prior to the copy deadline - 50% of the space cost agreed is payable;
    4. less then 7 days prior to the copy deadline - 100% of the space cost agreed is payable;
    5. discounts do not apply to cancelled advertisements and the full amount of the charges shall be payable (see 23: a-c);
    6. if an Advertiser cancels a balance of contract for a series booking it relinquishes any right to the series discount to which it was previously entitled; a surcharge will be raised to adjust the rate to the individual rate as appropriate.
  3. Cancellation charges for the website:
    1. 14 days prior to the specified publication date, the Advertiser is not liable to any penalty;
    2. 13 to 7 days prior to the specified publication date, 25% of the ad cost is payable;
    3. 6 to 3 days prior to the specified publication date, 50% of the ad cost is payable;
    4. less than 3 days prior to the specified publication date 100% of the ad cost is payable.
    5. discounts do not apply to cancelled advertisements and the full amount of the charges shall be payable (see 24: a-d).
